Pernambuco court dismisses Spribe AVIATOR claims against NSX

Trade desks dated 18 September 2026 report that a court in Pernambuco dismissed all claims by Spribe against NSX Brasil S.A. — operator of Betnacional — in the AVIATOR crash-game dispute. The rejected grounds, as attributed by those desks, were trademark infringement, copyright infringement, and unfair competition.

This is an IP fight over who can put AVIATOR in front of Brazilian players. It is not the SPA bank-block ordinance story and not the reported online-casino ban measure.

From injunction to merits dismissal

In April 2026, the Court of Justice of Pernambuco (TJPE) had granted Spribe an interim injunction ordering NSX to stop using the AVIATOR mark and confusingly similar elements, with daily fines threatened in desk coverage. In July 2026, the same court revoked that injunction after a Federal Court in Brasília provisionally suspended effects of Spribe’s Brazilian INPI AVIATOR registration. Judge Andrea Epaminondas Tenorio de Brito cited CPC Art. 296 in that revocation path, according to theiGaming.eu’s timeline.

The 18 September cascade says the merits claims have now been dismissed in full. Desk announcements did not publish the judgment calendar date, the merits judge’s name, or a case number — so those stay off this page.

What is still open

A federal INPI invalidation proceeding in Brasília, brought by Aviator Studio Brasil, remains the central trademark track. Separate São Paulo urgent measures against Aviator Studio were rejected in May 2026. Outside Brazil, a UK court ruling favouring Spribe on related copyright is neighbour context only.

In June, the Public Prosecutor’s Office of the Federal District (MPDFT) opened an inquiry into alleged misleading advertising by Spribe and recommended that SPA suspend technical certification of Spribe games. That recommendation is separate from the Pernambuco dismissal — and desks do not show that SPA has acted on it.

Why operators are watching

AVIATOR sits on many licensed Brazilian lobbies under the federal regime that began in January 2025. Control of the name decides who can license which crash title. The Pernambuco dismissal removes one immediate claim risk against NSX/Betnacional. It does not finally settle ownership while Brasília and possible appeals remain live.
