Justice Luiz Fux has called a public hearing at Brazil's Supreme Federal Court for 3 November on MP 1.394, the measure that bans fixed-odds betting. Twenty-six bodies are invited, from the government and operator associations to ten football clubs. It is a consultation, not a ruling: the ban stays in force.
Brazil's betting ban goes before its Supreme Court on 3 November, but as a hearing, not a verdict. Justice Luiz Fux, the rapporteur for the constitutional challenges to Provisional Measure (MP) 1.394/2026, has called a public hearing for Tuesday 3 November at 10:00 Brasília time (14:00 CET) in the Second Panel's session room at the Supreme Federal Court (STF). MP 1.394 bans fixed-odds betting in Brazil and ends the authorisations granted to the companies in the sector.
Fux signed the order (a despacho) on 26 October in the injunction request in ADI 8.027, the direct action of unconstitutionality brought by the industry associations ANJL and IBJR against the President of the Republic and the National Congress. He was answering requests from the Attorney General's Office (AGU), the ADI 8.027 plaintiffs and the amici curiae, outside parties admitted to the case. According to the STF's release, the AGU argued that experience since the court's previous hearing on betting in November 2024, new evidence on the impact of betting and the MP itself justify updating the debate.

What a public hearing is
A public hearing at the STF is a session where the rapporteur hears invited bodies before the court decides. Nobody is judged on the day, and the order neither grants nor refuses the injunction. It also sets no topics, speaking times or format, and gives no date for a decision.
Who has been invited
The order lists 26 participants:
- The challengers: CNC (ADI 7.721), the Prosecutor General (PGR, ADI 7.749), ANSEJA (ADI 8.024), ANJL and IBJR (ADI 8.027), the mayors' association ANPV (ADI 8.028) and the state lottery association Abracopel (ADI 8.035).
- The government side: the Attorney General of the Union and the Ministry of Finance.
- Industry, law and research bodies: the broadcasters' association ABERT, the criminal lawyers' association ABRACRIM, the UERJ Reg economic regulation lab of Rio de Janeiro State University, the national industry confederation CNI, ABLE and AIGAMING.
- Football: the Brazilian Football Confederation (CBF) and ten clubs: Flamengo, Fluminense, SAF Botafogo, Cruzeiro, São Paulo, Corinthians, Ponte Preta, Vitória, Guarani and Portuguesa.
A copy of the order goes into the files of the related challenges, ADIs 7.721, 7.723, 7.749, 8.024, 8.028 and 8.035. iGaming Business reports that the hearing will therefore serve to support the court in several betting cases.
In our view, the football presence is no accident. Estadão reports that betting companies' direct sponsorship made up 7.9% of Série A club revenue in 2025, and next.io reports that São Paulo, Botafogo, Cruzeiro, Fluminense and other clubs asked to be heard in the case in early October.
Where Brazilian players stand today
Nothing changes before the hearing. MP 1.394 remains in force, and the licences held by betting operators were extinguished on 25 October. We covered what that means for accounts and fees in our piece on the 25 October licence cut-off.
Two tracks are now running. In court, the hearing comes before any decision on the injunction or the merits. In Congress, the MP must be approved to become permanent law; next.io reports that its first 60-day period ends on 23 November and can be extended automatically. We are not predicting either outcome.
For the background, see how Lula's re-election affects the ban, the ANJL challenge to MP 1.394 and the AGU's earlier position on Brazil's betting laws.
This is a Brazilian court process; it does not change the rules in any other market. If gambling stops feeling like entertainment, use the limits and self-exclusion tools available where you play and local support services.
